Is there a way to ignore terms of use of content publicly available?

Several web-oriented businesses publish user-generated content with restrictions on the ability to use the data for analytics. Is there any way to parse and analyze that kind of content without risk of losing a lawsuit?

Some preliminar thoughts:

  1. If I access the content through a web cache like Google Cache, am I exempted from respecting content usage provisions?
  2. Is there any jurisdiction or legal scheme that is more "elastic" on what I can do with web-collected data?
